We, the undersigned citizens of the United States of America, hereby petition the Trump Administration, the United States Congress, and the Department of Justice to enforce the Communist Control Act of 1954 — a law that has never been repealed — against any organization, candidate, or officeholder who meets its statutory definition of a communist action group. The Democratic Socialists of America is that organization. The time for enforcement is now.

Therefore, be it resolvedWe call upon President Donald J. Trump, the United States Congress, the Attorney General of the United States, and all relevant Federal agencies to investigate and enforce the Communist Control Act of 1954 against the Democratic Socialists of America and any affiliated candidates seeking Federal or municipal office — applying the law that the Democratic Party itself wrote, because its authors understood what we are now witnessing.

What the law actually says
The Communist Control Act of 1954 (68 Stat. 775, codified at 50 U.S.C. §§ 841–844) outlawed the Communist Party of the United States and criminalized knowing membership in or material support for it. Signed into law by President Dwight D. Eisenhower on August 24, 1954, it declared the Party "an agency of a hostile foreign power" and "a clear, present, and continuing danger to the security of the United States," and stripped it of "the rights, privileges, and immunities of a legal body."
The Democrats wrote it
The Act was championed by Democratic Senator Hubert H. Humphrey of Minnesota — later Vice President of the United States — who called the Communist Party the "root of evil." It passed with overwhelming bipartisan support: 85–0 in the Senate and 305–2 in the House, and was signed by a Republican president. In Humphrey's own words, the goal was "to remove any doubt… as to where [Democrats and liberals] stood on the issue of Communism."
Why it was passed
Written at the height of the Cold War, the law was a direct response to an ideology whose openly declared aim was to overthrow constitutional government and abolish private property — an aim its authors believed should be unlawful even when pursued by peaceful or electoral means. As one writer of the era put it, there is "no place in democracy for those who want to abolish it even with a peaceful vote."
Has it ever been repealed?
No. Congress has never repealed the Communist Control Act, and the Supreme Court has never struck it down in its entirety. The law was rarely enforced, and some of its Cold War-era machinery — such as the Subversive Activities Control Board — was later dismantled, with several provisions criticized on constitutional grounds. But its central provisions were never overturned and remain valid federal law to this day.
Why it matters now
The Democratic Socialists of America openly advocates the abolition of capitalism and the collective ownership of the means of production — and its candidates are now winning elections in America's largest city. This petition calls on the federal government to apply the law the Democratic Party itself wrote, against the organized movement its authors built it to confront.
